DIS Statistics 2011

In 2011, the DIS was entrusted with the administration of a total of 178 (2010: 156, 2009: 177) new proceedings.

A total of 174 (2010: 155) new arbitral proceedings were commenced at the German Institution of Arbitration (DIS).

149 proceedings were initiated under the DIS-Arbitration Rules (2010: 131), including 1 proceedings initiated under the Supplementary Rules for Expedited Proceedings (DIS-SREP 08) and 3 proceedings under the Supplementary Rules for Corporate Law Disputes (DIS-SRCoLD 09).

3 proceedings each were based on the Arbitration Rules of the Frankfurt Chamber of Industry and Commerce and Munich, 2 each on the Arbitration Rules of the Chamber of Industry and Commerce of Cologne and Erfurt, and 1 each on the Arbitration Rules of the Chambers of Industry and Commerce of Berlin and Stuttgart. The Arbitration Rules of these Chambers of Industry and Commerce refer to the DIS Arbitration Rules and are administered by the DIS (12 proceedings in total under the Rules of Chambers of Industry and Commerce; 14 such proceedings in 2010).

The amounts in dispute of the cases filed range from € 3,000 to € 1,060,000,000. The aggregate amount in dispute of all cases filed directly with the DIS in 2011 amounted to approx. € 3.333 billion (2010: € 1.090 billion) and € 3.925 billion (2010: € 1.142 billion) including extensions of claims and counterclaims filed in 2011 in proceedings commenced in previous years. Including claims filed under the Arbitration Rules of the Chambers of Industry and Commerce, the total amount in dispute amounted to approximately € 3.946 billion (2010: € 1.147 billion).

In 55 proceedings (2010: 43) foreign parties were involved (34.2%) (2010: 29.7%). In 48 of these proceedings (2010: 33) one foreign party was involved on either the claimant or respondent side. In 7 of the proceedings, there were foreign parties involved on both the claimant and respondent side (2010: 10). In total, 63 foreign parties (16%) (2010: 59 = 16.1%) (some of the proceedings involving foreign parties were multi-party arbitrations) - out of a total of 393 parties (2010: 366) - from 26 countries (2010: 28) participated in DIS proceedings: Austria (2), Belarus (1), Belgium (2), Canada (2), Cyprus (2), Czech Republic (4), France (1), Great Britain (3), Guernsey (1), Ireland (1), Italy (2), Luxemburg (5), Monaco (1), Netherlands (12), Norway (1), Poland (1), Portugal (1), Russian Federation (4), Singapore (1), Sweden (1), Switzerland (4), Slovenia (1), Turkey (1), Ukraine (3), United Arab Emirates (2), USA (4).

26 of the cases newly filed in 2011 (= 16,1%) were conducted in English (2010: 26 = 18%).

In 8 cases (20010: 13) more than one party was involved on the claimant side; in 19 cases (2010: 17) more than one party was involved on the respondent side.

In 2011, substitute appointments of arbitrators were made in 8 instances (2010: 28). In no case (2010: 10) the chairperson of the arbitral tribunal, in 5 cases (2010: 12) the sole arbitrator and in 3 cases (2010: 3) the arbitrator for the respondent was nominated by the Appointing Committee of the DIS.

13 proceedings were filed under the DIS Arbitration Rules for Sport.

2 mediation/conciliation proceeding were filed under the DIS Mediation/Conciliation Rules, 2 Mediation proceedings were filed under the DIS Mediation Rules 2010.
