As of April 2025, Germany allows its federal states (Bundesländer) to establish Commercial Courts at the level of the Higher Regional Court. These courts specialize in economic disputes, allow for English as the language of the proceedings, and aim at being a real alternative to arbitration.
As part of a new “Brown Bag Lunch” series hosted by the German-Polish DIS/Lewiatan/PAA/PCC Arbitration Group, we will discuss with Marcin Asłanowicz, President of the Lewiatan Court of Arbitration and member of Civil Law Codification Committee in Poland, and Frank Bodendiek, judge at the Higher Regional Court and the Hanseatic Commercial Court in Hamburg, what to expect from the new Commercial Courts in Germany, whether they will be an alternative to arbitration, and whether such courts could also be an option for Poland.
