Arbitration tribunals are tasked with rendering awards – but what if they could also help parties reach amicable settlements along the way? Article 26 of the DIS Rules obliges the arbitral tribunal to seek to encourage amicable settlements, unless a party objects. How is such activity perceived internationally and how do parties in international arbitration proceedings respond to proposals from a tribunal to take steps to facilitate a settlement? The DIS Rules Clinic Practice Group on Settlement has published its report exploring these very questions. 

Join us for this Lunch DIScussion as we present the report’s key findings and discuss together with two experienced, non-German arbitration practitioners whether – and how – settlement facilitation can enhance international arbitration and deliver more time- and cost-efficient proceedings.
