DIS@HKAW 2026: Facilitating Settlement in Arbitration - Practice, Pitfalls and Potential

The DIS is one of the very few institutions that stipulates - in Article 26 of its Rules - an obligation for arbitrators to "seek to encourage an amicable settlement of the dispute or of individual disputed issues".

This event explores the role of settlement in arbitration as a tool for efficient dispute resolution and the possibilities arbitrators have to encourage it. Drawing on findings from the DIS Rules Clinic Report on Settlement Facilitation, experienced practitioners will discuss when and how tribunals can effectively facilitate settlement, the risks involved, how these techniques differ from Arb-Med-Arb, and whether the DIS model could be employed in Asia.
