German and Polish dispute resolution practice follows many similar patterns – the differences are visible either way. Together with arbitration and litigation experts from both countries we will touch upon the flagship German procedural solutions, like the court/tribunal’s upfront preliminary views on certain matters allowing the disputing parties to jointly shape the proceedings and focus on their submissions. We will discuss also those rooted in German litigation practice and visible elsewhere, like shareholder disputes and third-party notices. Aiming to learn from each other, we will exchange on the key aspects behind choosing an arbitral institution to administer future disputes from the in-house lawyer’s perspective, among others: RFA vs full statement of claim; expedited proceedings vs opt-out; and hard vs light award scrutiny.
