Taking advantage of a beautiful spring day, the DIS once again hosted an official Paris Arbitration Week (PAW) event on 9 April 2025. This year, we introduced and discussed the DIS Supplementary Rules for Third Party Notices to a full house at King & Spalding’s Paris office. There was a lively exchange on practical issues of dealing with the recourse trap in international arbitration ensued.
After a short introduction of the DIS by Reinmar Wolff, David Quinke explained how the new supplementary rules operate. Our panellists from France, Belgium, the Netherlands and Germany discussed: typical situations in which a party faces the risk of being “sandwiched“; how such situations can be addressed in contract drafting; and why an off-the shelf-solution of an arbitration institution makes much sense. We were delighted to have Karl Hennessee (Airbus) on our panel as well as Rogier Schellaars (DIS Council member). Marina Weiss (Bredin Prat) represented the AFA/DIS Arbitration Group, which co-sponsored the event.
In a final round-up, our panellists shared their views on the operability of the new supplementary rules with their own arbitration laws. Ramona Schardt was happy to receive many well-wishes for the next day’s ceremony of the GAR Awards, where the new supplementary rules were shortlisted for best innovation of an arbitration institution.
