On 25 September 2025, the DIS Regional Group Stuttgart organised an event that focused on the growing challenges of ESG disputes.
Speakers Anika Wendelstein (Luther) and Irina Novikova (Deloitte) explained how ESG disputes have evolved and can now be separated into several distinct categories, such as climate and environmental disputes, investment protection disputes, ESG compliance disputes, investor claims, greenwashing proceedings, human rights disputes, and directors' and officers' liability lawsuits. The discussion on current court rulings (e.g. Lluiya vs. RWE), which explore the limits of civil law and put proven concepts to the test, including those relating to causality and damage quantification, was particularly insightful.
The event not only offered in-depth content, but also lively discussion with participants from the legal profession and the judiciary. It was a successful evening that once again demonstrated how dynamic and relevant the topic of ESG has become for dispute resolution.
