DIS Meets KCAB International: Civil Law Players in International Arbitration

Geographically far apart, yet legal culturally closely related in the civil law tradition: Korea and Germany.

East Asia belongs predominantly to the civil law legal family, including strong ties to the German legal tradition, yet many German or Korean users still routinely select popular common law venues as seat of their arbitration. This can lead to lengthy and costly common law inspired arbitration proceedings with broad document disclosure, extensive cross-examination, no support with an early settling of the dispute etc.

For an open exchange among civil law players in international arbitration, the DIS and its Frankfurt Regional Group welcome Prof. Chang, Chairman of the Korean Commercial Arbitration Board (KCAB) International to Frankfurt in our “DIS Meets KCAB International” format. Prof. Chang will introduce his arbitration institution to us and share some initiatives that KCAB International has taken to raise awareness of the civil law traditions in arbitration, such as his successful Asia Civil Law Summit.

After a short presentation on typical civil law approaches to arbitration, we will discuss convergences and perspectives of civil law inspired international arbitration.
