Mediation is a non-contentious mechanism for the resolution of disputes. So why should there be a need for advocacy in such a process? This panel believes that the mediation process benefits from advocacy, if it is the right kind that supports the process rather than hindering it.
We will discuss from a counsel’s perspective, from a mediator’s perspective and from an inhouse perspective what good mediation advocacy looks like and how it should be used in the different phases of the mediation proceedings.
