Praxislabor: Veranstaltungen

On 19 January 2023, the virtual Round Table 6 of the Practice Group Technology will take place from 16.00-18.00. The moderators Alexander Foerster and Dr. Paul Hauser are happy to welcome a panel consisting of Dr. Gisela Knuts, Helsinki, Lise Alm, Stockholm and Jessica Puhr, Vienna. The panel will cover different issues of electronic communication and document management in arbitral proceedings and discuss the process of implementing a platform into the administration of arbitration by institutions and the challenges in convincing arbitration practitioner to use this new tool.

Dr. Mariel Dimsey, LL.M. and Francis Xavier, SC, PBM, FCIArb and Chartered Arbitrator will present their perspectives on this topic in a discussion moderated by Dr. Axel Reeg.  The session will be interactive and will allow for participants to ask questions of our speakers.

As part of the 2018 DIS Arbitration Rules Clinic initiated in 2021, the practice group settlement has dedicated itself to the distinctive feature of the 2018 DIS Arbitration Rules: early conflict resolution. The promotion of settlements is one of its pillars. The practice group analyses how settlements are brought about around the globe.

In Phase 1 the practice group has held several interactive sessions with thought leaders (such as David Rivkin, Edna Sussman, Klaus Peter Berger, Karl Mackie or Christopher Newmark). Future sessions with thought leaders in this area are planned. Phase 2 of the project will aim to develop approaches to settlement facilitation in light of the findings from Phase 1. In working groups focusing on different regions, gaps between the various legal traditions will be identified and discussed.

The kick-off event of Phase 2 will take place on 15 November 2022, 1:30 pm (CET).

On 13 October 2022, the virtual Round Table 7 of the Practice Group Technology will take place from 16.00-18.30. The speaker Prof. Dr. Thomas Riehm will cover future uses of technology in arbitral proceedings such as e-adjudication, AI-predictive analytics and blockchain arbitration.

The event is Postponed.

The Practice Group Settlement organises a series of sessions with experts on various aspects of our topic of settlement facilitation, as well as panel discussions among representatives of a range of arbitral institutions who will provide regional perspectives.

The third session with Christopher Newmark and Karl Mackie will take place on 7 July 2022 at 17.30-19.00 CET.  They will be presenting their views and experience on the topic ‘The CEDR Rules for the Facilitation of Settlement in International Arbitration: Applying the Rules in Practice’.

Die Leiter der Praxisgruppen „Effizienz und Kommunikation“ und „Sachverständige“ laden Sie herzlich zum Start der Online-Veranstaltungsreihe „Berichte aus dem DIS-Praxislabor“ am 30.06.2022 von 14.00 bis 16.00 Uhr ein. Im Rahmen der ersten Veranstaltung möchten die Praxisgruppenleiter zu ihren vorläufigen Erkenntnissen berichten.

Die Praxisgruppe „Effizienz und Kommunikation“ wird insbesondere ihre Erkenntnisse zu Erwartungen an die Verfahrensadministration, Herausforderungen bei der Kommunikation mit Verfahrensbeteiligten sowie zu weiteren Aspekten der effizienten Führung von Schiedsverfahren teilen.

Die Praxisgruppe „Sachverständige“ wird eine Practice Note zum Sachverständigenbeweis in Schiedsverfahren vorstellen.

On 23 June 2022, the virtual Round Table 5 of the Practice Group Technology will take place from 16.00-18.30. The speaker Prof. Dr. Thomas Riehm will cover the topic of legal risk analysis tools, including for example decision tree software and sensitivity analysis tools.

Der sechste Diskussionstermin der Praxisgruppe Article-by-Article findet am 02.06.2022 von 16.00 bis 18.30 Uhr statt. Die Praxisgruppe wird sich der Diskussion der Fragen, Anmerkungen, Vorschläge und Kommentare ihrer Mitglieder zu den Artikeln Art. 37 bis 45 DIS-SchO widmen.

On 12 May 2022, the virtual Round Table 4 of the Practice Group Technology will take place from 16.00-18.30. The speakers Alexander Foerster and Dr. Paul Hauser will cover different issues of virtual hearings in arbitral proceedings, including the use of dedicated platform providers for virtual hearing rooms and the presentation of evidence.

The Practice Group Settlement organises a series of sessions with experts on various aspects of our topic of settlement facilitation, as well as panel discussions among representatives of a range of arbitral institutions who will provide regional perspectives. The second session with Edna Sussman and Klaus Peter Berger will take place on 27 April 2022 at 17:00 CET.  They will address the Mixed Modes Task Force Report on Arbitrator Techniques and their (direct or potential) effect on settlement.

On 21 April 2022, the virtual Round Table 3 of the Practice Group Technology will take place from 16.00-18.30. The speaker Prof. Dr. Thomas Riem will cover the subject of technology usage during arbitral hearings, including electronic hearing transcripts (court reporter and AI-based, interpretation) and presentation technology such as augmented reality.

Der fünfte Diskussionstermin der Praxisgruppe Article-by-Article findet am 06.04.2022 von 16.00 bis 18.30 Uhr statt. Die Praxisgruppe wird sich der Diskussion der Fragen, Anmerkungen, Vorschläge und Kommentare ihrer Mitglieder zu den Artikeln 32 bis 36 der DIS-Schiedsgerichtsordnung sowie der Anlage 1 (Geschäftsordnung) und der Anlage 2 (Kostenordnung) widmen.

Das zweite Treffen der Praxisgruppe Settlement findet am Mittwoch, den 23.03.2022 von 9.00-13.00 Uhr statt. In dem Treffen werden die gesammelten Anmerkungen der Mitglieder der Praxisgruppe zum Entwurf einer Practice Note ‚Sachverständige‘ besprochen.

On 17 March 2022, the virtual Round Table 2 of the Practice Group Technology will take place from 16.00-18.30. The speaker Dr. Alexander Seitz and Dr. Felix Dörfelt will cover the subjects of data security and data protection in arbitration, including encryption standards and related reliability and confidentiality aspects, as well as the use of illegally obtained evidence.

The Practice Group Settlement organises a series of sessions with experts on various aspects of our topic of settlement facilitation, as well as panel discussions among representatives of a range of arbitral institutions who will provide regional perspectives. The first of these virtual the sessions will be held with David Rivkin (Partner, Debevoise & Plimpton, New York), who will be presenting and discussing his decision tree approach to case management and Town Elder Rules on 17 March 2022 from 15.00 to 16.30h (CET).

On 3 March 2022, the virtual Round Table 1 of the Practice Group Technology will take place from 16.00-18.30. The speaker Dr. David Tebel and Dr. Felix Dörfelt will cover the subjects of e-discovery, document production including the use of AI, as well as collaboration tools and the associated disclosure risks.

The kick-off session for the work of the practice group settlement will include an opening discussion addressing case management strategies that may eventually lead to dispute resolution followed by a presentation of the detailed program of the practice group.

The session will take place on Tuesday, 22 February 2022 at 17.00 via zoom. An invitation has been sent separately to the members of the practice group.

Der vierte Diskussionstermin der Praxisgruppe Article-by-Article findet am 09.02.2022 von 16.00 bis 18.30 Uhr statt. Die Praxisgruppe wird sich der Diskussion der Fragen, Anmerkungen, Vorschläge und Kommentare ihrer Mitglieder zu den Artikeln 21 bis 31 der 2018 DIS-Schiedsgerichtsordnung widmen.

Bei dem ersten virtuellen Treffen der Praxisgruppe Sachverständige möchte die Leitung der Praxisgruppe am Montag, den 13.12.2021 von 14 bis 16 Uhr mit den Teilnehmerinnen und Teilnehmern der Praxisgruppe Ziele, Zeitplan und das angestrebte Arbeitsprodukt besprechen.

In its preparatory session, the Practice Group Technology will start off with a discussion on the approach to its upcoming roundtables in a short videoconference. The discussion will take place on 28 October 2021 from 12:00-13:00.

Alexander Foerster, Partner bei Mannheimer Swartling in Stockholm, spricht am 26.10.2021, 12:00-13:30 Uhr über seine Erfahrungen mit der Arbeit mit digitalen Material und Kommunikationsplattformen. Im Fokus stehen insbesondere seine vielfältigen Erfahrungen als Parteivertreter und Schiedsrichter mit der digitalen SCC Platform der Stockholm Chamber of Commerce.

Wir laden herzlich zur nächsten DIS40 Rhein/Ruhr Online-Veranstaltung zum Thema „Mehrparteienschiedsverfahren“ ein. Die Veranstaltung findet im Zeichen des Praxislabors 2018 DIS-Schiedsgerichtsordnung statt.

Die neue DIS-Schiedsgerichtsordnung 2018 ist nunmehr drei Jahre alt. Damit ist es an der Zeit, ein erstes Resümee über die inhaltlichen Neuerungen zu ziehen. Dazu gehören die Artikel 18-20 DIS-SchO 2018, in denen die Beteiligung von mehreren Parteien an einem Schiedsverfahren geregelt ist. Mehrparteienschiedsverfahren können Schiedsgerichte und Schiedsinstitutionen vor erhebliche Herausforderungen stellen. Darüber möchten wir uns mit drei Praktikerinnen aus der Anwaltschaft und der DIS austauschen.
