This decision was prompted by the recognition that the current fee levels, which have remained unchanged since 1 March 2018, are significantly lower than those of leading international arbitral institutions.
The revised Schedule of Costs, which will enter into force on 1 March 2026, provides for an increase of approximately 20-25 % in the lump-sum fees for arbitral proceedings involving amounts in dispute of up to EUR 100,000.
For disputes whose amounts in dispute range from EUR 100,000 to EUR 100,000,000, the graduated percentage rates applicable to arbitrators’ fees will undergo a moderate increase. Altogether, these adjustments will result in a noticeable yet measurable improvement in arbitrators’ remuneration for this range of amounts in dispute.
For very high amounts in dispute more than EUR 100,000,000, the percentage increase in fees will be slightly reduced, with a view to curbing the overall rise in arbitrators’ fees in this segment.
Through this revised fee structure, the DIS generally aims to enhance the attractiveness of serving as an arbitrator and to better reflect the high level of expertise and responsibility involved, while remaining mindful of the cost implications for the parties. The adjustments have therefore been deliberately designed to continue to remain below those of other leading international arbitral institutions, thereby preserving the DIS’s position as a high-quality yet cost-conscious provider of arbitration services.
