Appearing as a witness and being cross-examined can be intimidating. Understandably, a witness wants to understand the process and give their own recollection of the relevant facts. Similarly, a witness wants to rely on legal counsel for assistance in preparing for this process. However, excessive witness preparation may be seen as distorting witness evidence. We will explore and discuss this tension together with a fantastic group of experts who will share their unique views and experiences with us. In particular, we will explore the perspective of an inhouse counsel and their expectations, discover what we can learn from criminal cases and criminal procedure and combine it with the views and approach of an arbitration counsel. How can we prepare a witness in the best way possible and further our client’s case without crossing the boundaries of what is legally permitted?
